Courts split on when the NLRB can get a quick injunction

The Seventh Circuit refused an NLRB request under Section 10(j) to reinstate a decertified union and called the remedy “extraordinary.” That deepens a circuit split. The Ninth Circuit, which covers California, has applied a more lenient standard.

The current contract has a no-strike clause. Under the Dills Act, the question is whether an unfair practice opens a legal path to strike.
